Fire Risk Assessment Terms and Conditions

  1. Definitions

Contract – The quotation (if any), these Terms and Conditions, and the purchase order accepted by us in writing.

Fire Safety Services – Fire safety services we provide, including fire risk assessments and reports, as described in the quotation and/or schedule.

Purchase Order – The order you place with us for the Services.

Quotation – Our written statement of prices for the Services described.

Services – The fire safety services.

We / Us / Our – Alpha Six Fire Door Consultancy Ltd.

  1. Order of Precedence

We supply Services strictly under these Terms and Conditions. Any terms you specify (including in a purchase order) will not apply unless agreed in writing.

  1. Price, Payment & Interest

(a) You must pay our charges (plus VAT) within 30 days of invoice or in accordance with agreed direct debit terms, without set‑off or deduction.

(b) We may adjust charges on or after the first anniversary of the Contract based on relevant indices.

(c) We may suspend Services for non-payment, charge interest under the Late Payment of Commercial Debts Act, or apply call‑out fees as applicable.

  1. Delivery of Services

Service delivery dates are estimates only. We require access to your premises.

 

  1. Title to Reports

We retain copyright over all supplied documents. You are granted a royalty‑free licence for internal use.

  1. Limits of Liability

We are not liable for failure to follow recommendations or for issues arising after the assessment.

(a) We accept liability for:

  • Personal injury or death caused by our negligence.
  • Property damage caused by our negligence, limited to £50,000 per claim.

(b) We provide no warranties on materials or parts unless contracted directly.

(c) We are not liable for indirect losses.

(d) Claims must be notified in writing as soon as possible.

(e) Liability is capped at £10,000 per claim.

(f) These limits continue after Contract termination.

  1. Excusable Events

If circumstances beyond our control prevent delivery for over 3 months, either party may cancel. You only pay for work already completed.

  1. Ending the Contract

(a) We may end the Contract for breach, incorrect information, insolvency, or unsatisfactory credit results.

(b) You may end the Contract with notice if we materially breach and fail to remedy within 30 days.

(c) Early termination of multi‑year services requires payment of outstanding charges.

(d) Early termination requires payment of 50% of remaining charges.

   10. General

Restrictions on assignment, no third‑party rights, written variations only, and English law applies.

  1. Anti-Bribery

No party may engage in bribery. This clause survives termination.

  1. Data Protection

Compliance with data privacy laws, lawful sharing, global secure storage, and breach notifications as required.

  1. Credit Checks

We may share your information with CRAs to assess creditworthiness.

  1. Agreement Change Events

We may adjust charges or vary Services following events such as Brexit impacts, pandemics, changes in law, sanctions, tariffs, or other significant economic changes.

  1. Client Responsibilities

You must provide accurate information, documentation, and confirm the Responsible Person under the Fire Safety Order.

  1. Access and Site Safety

You must ensure safe site access, provide permits where required, and ensure unrestricted access. Limitations will be recorded where access is restricted.

  1. Limitations of the Fire Risk Assessment

Assessments are non‑destructive unless agreed. Specialist surveys are excluded unless contracted. Assumptions may be made where access is restricted.

  1. Asbestos & Hazardous Materials

We will not disturb suspected asbestos. You must inform us of known ACMs. Restricted access due to hazards will be noted.

  1. Fire Safety Compliance

Assessments follow applicable guidance but do not certify full compliance. You are responsible for implementing recommendations.

  1. Validity Period

FRAs remain valid until building changes occur. Annual review is recommended.

  1. Insurance

We maintain appropriate professional indemnity and public liability insurance.

  1. Confidentiality

Both parties must keep information confidential unless disclosure is legally required

  1. Intellectual Property

Templates, methodologies, and systems remain our intellectual property.

  1. Follow-Up Support

Clarification queries are included. Additional support or revisits may incur charges.
